It is not disputed that identical challenge was raised in Writ Petition No. 5155/2016 by the present petitioner against the respondents. This Court allowed the petition by order dated 03.01.2020. The present petition, therefore, needs to be allowed for the reasons recorded in Writ Petition No.5155/2016.

Hence, the present petition is allowed. The impugned order dated 07/07/2016 (Annexure - I), is hereby quashed and set aside. Complaint ULP No.72/2012 is restored to the file of Industrial Court, Yavatmal. The parties to appear before the Industrial Court, Yavatmal on 08/09/2021. The Industrial Court, Yavatmal, shall decide the complaint, as expeditiously as possible and preferably within a period of six months from the date of first appearance of the parties.
