DATE : November 02, 2017 In view of judgment of the Division Bench in Babu Ulingappa Batteli vs. State of Maharashtra and Ors. 2012 (4) Mh.L.J. 760 and as the judgment passed by the Judicial Magistrate First Class is dated 06/04/2015, Shri R. R. Vyas, learned counsel for the applicant seeks permission to withdraw the present application with liberty to file an appeal under Section 372 of the Code of Criminal Procedure, 1973.

Application is permitted to be withdrawn with aforesaid liberty and disposed of as such.
