The matter was heard earlier on 12.09.2018 and time was given to Ms. Rakhi Sarkar, learned counsel for the petitioner. Today in the morning, the learned counsel started arguments but then obtained adjournment till second half to answer the query of this Court. 2.

The contention was, other employees received some communication in 1984 only while the petitioner got the same on 28.02.2018. The communication issued in 1984 is not placed on record. At Annexure - II (page 31) is an order dated 28.02.2018 by which the pension, commutation and gratuity etc. of the petitioner have been determined consequent to his superannuation on 31.08.2017.

As the Court wanted to understand the effect of communication allegedly dated 17.04.1984, the matter was adjourned earlier and today also. As there is no appearance, we dismiss the petition for want of prosecution. No order as to costs.
