ATE : SEPTEMBER 02 , 2024 It is unfortunate to observe that since 22/09/2022 the Federation of the petitioner Society is managed by an Administrator pursuant to Section 77(A) of the Maharashtra Cooperative Societies Act, 1960.
2) It seems that the respondent No.1 State is of the view that the Management of the Federation shall be continued under the aegis of an Administrator contrary to the said provision though the statutory period is already over.
3) The least that was expected from respondent No.1 in such an eventuality is to direct the respondent No.2 to hold the elections of the Federation Society forthwith. It appears that a vague statement has come on record from the respondent No.1, which reads thus :- "5.
I say and submit that the Administrator, Nagpur District Labour Cooperative Federation vide letter dated 11/06/2024 has communicated to the District Cooperative Election Officer-cum-District Deputy Registrar to fix the cut off date for preparation of provisional Voter list. The copy of letter dated 11/06/2024 is annexed and marked as Annexure R-1."
2 63-wp 4180.2024.odt 4) In view of the statements made in paras 5, 6, 7 and 8 of the affidavit of respondent No.1, we deem it appropriate to direct the respondent No.2 to start the election process of the Federation Society forthwith and complete the same within statutory period. Let the compliance be placed on record by the respondent No.2.
