Heard learned counsel for respective parties. 2.

A prayer made in this petition is to direct respondent No. 2 to implement and follow Resolution No. 3 of Board of Directors, passed in meeting held on 9.2.2010 and implement the revision of pay structure as per the recommendations of the 6th Pay Commission w.e.f. 1.1.2006.

Mr. Thakur, learned counsel for petitioner by relying upon said Resolution has contended that the petitioners are entitled for pay scales as per 6th Pay commission from 1.1.2016. Per contra, Mr. Subhedar, learned counsel for respondent nos 2 and 3 submits that since the financial and administrative supervision is of the Government, they cannot take decision on its own. Mr. Subhedar, further submits that though they are in a fit financial position and are supporting the stand taken by the petitioners, final call is required to be taken by State Government. Mr. Subhedar in order to buttress his contention regarding financial fitness has brought to our notice various balance sheets duly audited by competent authority.

Be that as it may, considering the fact that claim of the petitioners has been supported by respondent Nos. 2 and 3, relying upon the certain documents, we direct respondent No. 1 to take into consideration the claim made by the petitioners after considering the documents showing financial fitness of respondent Nos. 2 and 3, within four months from production of copy of this order. Needless to mention petitioners and respondents shall appear with all the necessary documents before respondent No.1 on 14.01.2026 at 11.00 a.m. Petition is disposed of.
