According to learned counsel for the petitioner, the respondent No.3 resides at house No.128 as per voters' list. In the reply filed on behalf of respondent No.3 it is stated that a demand was issued for payment of taxes on 03/05/2015 and the taxes were paid on 16/07/2015. The receipts are annexed to the nomination paper. Along with reply receipt for house No.120 has been filed. The elections are scheduled on 04/08/2015.
Considering the disputed questions that arise and in view of the fact that remedy is available after declaration of results, I am not inclined to exercise writ jurisdiction at this stage. Keeping the remedy available to the petitioner open along with points raised in the petition, the writ petition stands disposed of. JUDGE Asmita
