Learned A.P.P. submits that the petitioner has not moved before the Competent Authority seeking parole and instead filed an application for suspension of sentence and for grant of bail, which the authority cannot consider, having no jurisdiction.

Thus, it appears that the petitioner has approached a wrong forum for seeking suspension of sentence. He should have made request for releasing him on parole, which he could still make.

With the aforesaid liberty, we dispose of the petition. 5.
