Heard Advocate Mr. Gandhi, learned counsel for the petitioners.

The petitioners challenge is to the order passed by the learned trial Court rejecting the request for clubbing of the civil suit.

Counsel for the petitioner submits that although issues are not framed in the suit filed by the petitioner i.e. Special Civil Suit No.122/2024, in view of the similarity in the subject matter and for the sake of convenience, the two civil suit ought to have been clubbed.

He submits that since the issues are yet to be framed petitioner is entitled to submit the application for clubbing after the issues are framed in his civil suit. In support of his submissions, he relies on an order dated 14.12.2018 passed by this Court in Writ Petition No.3685/2016. In view of this, he seeks permission to

wp3723.25.O.odt withdraw the petition with liberty to file appropriate application at the relevant stage.

Petitioner is permitted to withdraw this petition with liberty as prayed for.
