The limited grievance of the petitioner is that the measurement on the basis of which the V.I.D.C. proposes to settle the bill for work done, was done in the absence of the petitioner.

02] The stand of the V.I.D.C. is that although the petitioner was telephonically informed to remain present, he did not and the V.I.D.C. went ahead with the measurement. 03] We are not inclined to delve deeper in the controversy since the parties have agreed that a fresh measurement shall be done in May, 2023, after the water recedes.

04] The measurement may be done on 22nd of May, 2023, which according to the V.I.D.C. is the convenient date. 05] The parties shall remain present at the spot at 11:00 on 22nd May, 2023.
