Heard the learned counsel for the appellant.

According to the learned counsel for the appellant, the First Appeal No. 1084 of 2017 is already disposed of with direction to the Assistant Charity Commissioner, Nagpur to dispose of the matter, pertaining to change report within a period of 4 months. It is an admitted fact that, during the pendency of the present appeal, the election between the original members of the Society has taken place and change report was filed before the Assistant Charity Commissioner. The said change report was allowed. The said change report was challenged before the Joint Charity Commissioner in revision and the same was allowed by the Joint Charity Commissioner, Nagpur and the matter was remitted back for fresh hearing. This position is not disputed.

However, the learned counsel for the appellant raised some objections to the admission of members. The said issue about the admission of members and other issues can be agitated before the Assistant Charity Commissioner in pending change report.

In view of above, the appeal stands disposed of. It is made clear that the points raised in this appeal expressly kept open to be agitated before the Assistant Charity Commissioner.

No order as to costs.
