Heard the learned Counsel for the petitioner. When it was pointed out to the learned Counsel for the petitioner that a new ordinance has come into force with effect from 27th June, 2018 deleting the provisions of Section 9A from the Code of Civil Procedure with retrospective effect, the learned Counsel for the petitioner, then not aware of the new development, verified the position and came back to the Court confirming the new development.
The result of the new development, as stated above, is that the grievance raised in this petition, would no longer survive as the provision of Section 9A of C.P.C. itself has been done away with retrospective effect. In these circumstances, the petition has to be disposed of having been rendered infructuous and it is disposed of accordingly. However, the trial Court is directed to proceed in the matter in accordance with law by taking into consideration the new development. JUDGE *sandesh
