16/09/ The present application is filed for suspension of substantive sentence and for releasing the applicant on bail.

It is pointed out that the matter is already admitted vide order dated 28/07/2022. In view of the pendency, matter could not be finally heard in near future. The applicant is near about 65-66 years of age. He is a retired person and awarded four years rigorous imprisonment along with fine of Rs.15,000/-, in default, rigorous imprisonment for one month. 3.

Learned Additional Public Prosecutor filed reply and opposed the application vehemently. 4.

Considering the quantum of punishment and age, execution of substantive sentence passed by learned Special Judge (under Prevention of Corruption Act) Bhandara in Special Criminal ACB

2 914 appeal 483-2022 Case No.07/2017 dated 19/07/2022 is hereby suspended.

In view thereof, the applicant be released on bail on his furnishing P.R. Bond of Rs.15,000/- with one solvent surety in the like amount to the satisfaction of the trial court.

The application stands disposed of.
