Apprehending arrest in connection with Crime No.453 of 2017 registered for the offence punishable under Section 7 of the Prevention of Corruption Act, 1988, the applicant has sought pre-arrest bail. The crime is registered on the complaint that the applicant who is working as Clerk in the Sub-District Hospital, Pandharkawada and at the relevant time was the only clerk working in that office, demanded an amount of Rs.1,20,000/- from the complainant to process the bills for disbursement of the amount receivable by the complainant and his family members after the death of father of the complainant.

According to the Investigating Agency, the applicant is suspended. The application is opposed on the ground that earlier also there had been similar complaints against the applicant and looking to the nature of the accusations, custodial interrogation of the applicant is required.

2 aba467.17 In the facts of the case, I am not inclined to consider the prayer of the applicant, the application is dismissed.

The applicant is granted interim protection by the order passed on 30th June, 2017. The applicant shall surrender within three days, failing which note of his conduct shall be taken at all stages of the proceedings. CRI.APPLN.(APPP) NO.1060/2017 In view of dismissal of the bail application, the application praying for time to file certified copy of order does not survive, hence, it is disposed of.
