Heard Shri R.D. Karode, learned Counsel for the petitioner, Shri Anjan De, learned Counsel for respondent no.1 and Ms. R. Kalia, learned A.G.P. for respondent nos.3 and 4.

Petitioner claims difference in amount of gratuity on account of wage revision.

Learned counsel for respondent no.1 has filed an affidavit. Respondent has accepted the liability and pointed out reason that large number of employees to whom amount has to be paid. A schedule is also been drawn by respondent Municipal

It is not in dispute that on 20.12.2016, similar controversy has been looked into in Writ Petition No.5294/2016 and this Court had allowed the said Writ Petition in view of statement, that petitioner therein namely - Abdul Ahad Kha Ahmed Kha would be paid his dues on or before 31.05.2017.

Here respondents states that amount will paid to present petitioner on or before 31.08.2017. 6.

We accept the said statement and dispose of the Writ Petition accordingly. No costs.
