By this application, the applicants are seeking transfer of divorce petition filed by the respondent against applicant No. 1 in the Family Court III, Nagpur to the competent Court at Bhandara.

The material placed on record shows that due to matrimonial dispute between the parties, they have been living separately. The applicants are residing at Bhandara with the father of the applicant No. 1. It is stated that the the applicant No. 1 is required to take care of her minor son. The applicant No. 1 has already initiated proceedings under the provisions of the Protection of Women from Domestic Gohane

) in the competent court at Bhandara which the respondent is required to attend.

Learned counsel for the respondent, on instructions, stated that he has no objection for transfer of the proceedings as prayed in the present application. In view of this, the application is allowed. Although in the prayer clause, it is stated that the divorce petition be transferred from the Family Court III, Nagpur to the Court of Civil Judge, Senior Division, Bhandara, learned counsel for the applicants submits that now there is a Family Court at Bhandara to which the proceedings can be transferred.

In view of above, the divorce petition filed by the respondent bearing HMP No. A-116/2017, pending before the Family Court No. III Nagpur, is transferred to the Family Court, Bhandara. The aforesaid Family Court No. III, Nagpur is directed to transfer the record of the proceeding to the Family Court at Bhandara at the earliest.
