On 22.08.2025 this Court has passed the following order, which is reproduced below;

"Heard Ms N. S. Pathan, learned Advocate for the petitioner. 2.

The petitioner husband has challenged order passed by the Civil Judge Senior Division, Akola under Section 24 of the Hindu Marriage Act granting maintenance pendente lite of Rs. 4000/- per month.

In view of the contentions advanced, issue notice to the respondent, subject to the petitioner depositing an amount of Rs. 25,000/- within two weeks in this Court from today.

After the amount is deposited, notice be issued, returnable thereafter two weeks."

Thereafter on 22nd September 2025 the learned counsel for petitioner has sought time to deposit the amount in accordance with order dated 22nd August 2025 and one week time was granted

2 6. WP4803.25.odt specifically observing that, on failure of the petitioner the order dated 22nd August 2025 shall stand recalled. Record indicates that there is no compliance with the order dated 22nd August 2025. 3.

Learned counsel for petitioner expresses inability on the part of the petitioner to comply with the order dated 22nd August 2025. Since the impugned order passed on 18.11.2024, is an order directing grant of maintenance pendente lite to the wife, at Rs. 4,000/- per month from the date of application and since the petitioner has filed to deposit the amount of Rs. 25,000/- to show his bonafides, the petition need not be entertained. The petition is therefore dismissed.
