The learned counsel appearing for the respondent submits that respondent No.2 is no more. She places on record the death certificate issued by the Department of Health, Satranjipura Zone No.7, Nagpur, issued on 19/06/2020, wherein it is shown that Muralidhar Jiwatuji Nimje (respondent No.2), passed away on 04/06/2020. Therefore, the appeal is abated against respondent No.2.

The learned counsel for the appellant submits that he is no longer interested in pursuing the appeal against respondent No.1 and does not press the appeal so far as respondent No. 1 is concerned.

In this view of the matter, as the appeal stands abated against respondent No.2 and is not

45-Cr.APPEAL-414-2012 pressed against respondent No.1, the appeal is disposed of accordingly.
