This petition takes exception to the order dated 06/06/2024 passed by respondent No.1-the Divisional Commissioner, Amravati in Appeal No.07/RTS-64/Shegaon/ Buldhana/2024.

Respondent No.2 herein has filed the aforesaid appeal. By the order impugned, respondent No.1 has stayed the order passed by respondent No.3 - the Additional Collector, dated 09/05/2024.

The learned counsel for the petitioner submits that respondent No.1 has not granted opportunity of hearing to the petitioner before passing the impugned order. However, considering the facts and circumstances, instead of examining the matter on merit, it would be appropriate to direct

910. WP 4286 of 2024.odt respondent No.1 to decide the appeal itself. Respondent No.1 - the learned Divisional Commissioner shall endeavour to decide the appeal in question within a period of three months from the date of receipt of copy of this order.

The writ petition is disposed of in the aforesaid terms. No order as to costs.
