It is an undisputed position that one of the teachers in the School is required to be declared as surplus, because of fall in the strength of students. 3.

The principles laid down in Rule 27[e] of the Maharashtra Employees of Private Schools (Conditions of Service) Regulation Rules, 1981, are required to be followed while effecting retrenchment. 4.

We therefore, direct respondent -

Order 2711wp3567.18 Education Officer to pass appropriate orders in terms of the said Rule, after ascertaining the position from the management on the aspects relevant for the purpose of operation of the said Rule.

Till the matter is decided by the Education Officer, parties are directed to maintain status-quo. 6.

Writ Petition is disposed of with above directions. No costs.
