DATE : 20/08/2022 Misc. Civil Application No.522/2022 and Misc. Civil Application (CAO) No.631/2022 1.

In pursuance to order dated 22.6.2022, the applicant was required to deposit the amount of Rs.7,06,631/- along with interest, @ 9 % p.a from 26.5.2017 within four weeks. The order of issuance of notice was also subject to deposit of the aforesaid amount and failure to do so, was to result in dismissal of the petition without reference to the Court. The time expired on 20.7.2022, during which the deposit was not made. The petition thus came to be dismissed.

The present applications seek to make deposit and so also to restore the petition. The applications have been filed on 25.7.2022 which mention the cheques for the

(2) 3.mca.522.2022 amounts as mentioned in the order dated 22.6.2022. Considering that the legal rights are involved, in view of which the Court finding a prima facie case, had issued notice, the applications are allowed.

The petition is restored.

The petitioners to file the cheques in the Registry, during the course of the day.
