The applicant is seeking pre-arrest protection in Crime 916/2020 registered with the Warora Police Station for offences punishable under Section 65(e) of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code.

The applicant appears to be a serial offender and is facing multiple prosecutions for similar offence, initiated in 2018, 2019 and 2020. Adverting to the facts of the present application, a vehicle was intercepted, huge quantity of liquor was seized and the driver of the vehicle revealed that it was the applicant who placed the order for the contraband liquor with him.

In view of the criminal antecedents and the prima facie material which links the applicant with the crime, I am not inclined to exercise discretion.
