2] The daughter of the applicant, who is the star witness in the instant case, is aged around 8 years. It is stated that the applicant has three minor children, who are right now in the custody of parents of the applicant.
3] Learned A.P.P. raised his apprehension that if the applicant is released on bail, there is every possibility that the daughter of the applicant, who is the star witness, may not support the case of the prosecution.
4] I found substance in the aforesaid submission made by the learned A.P.P. and, therefore, the trial Court is directed to expedite the trial, and to
9BA 1185.2020 record the statement of the daughter of the applicant at the first instance, after framing of charge. 5] Accordingly, learned counsel for the applicant is permitted to withdraw this application. Liberty is granted to the applicant to approach this Court again, after the statement of the daughter of the applicant is recorded.
6] The application stands disposed of accordingly.
