The learned advocate for the petitioner, on instructions, has submitted that a communication is issued by the Deputy Chief Labour Commissioner, Ministry of Labour and Employment, New Delhi on 4th January, 2018 directing the Chairman cum Managing Director, M/s. Manganese Ore (India) Limited, Nagpur to conduct election for granting of recognition to the majority union by secret ballot and after the process of secret ballot election is over, to continue wage negotiations. It is submitted that as now the process for negotiations for implementing new wage structure is initiated, the challenges raised in the petition are not being pressed.

In view of the above, the petitioner seeks liberty to withdraw the writ petition.

The writ petition is disposed accordingly. In the circumstances, the parties to bear their own costs. JUDGE RRaut..
