This petition takes exception to the order dated 28th May, 2024 passed by the respondent no.1 in Revision No. 43 of 2022.

By the order impugned, in view of the decision of this Court dated 24th April, 2024 in Writ Petition No. 14389 of 2019, the respondent no.1 has dismissed the revision filed by the present petitioner under Section 9 of the Maharashtra Money Lending (Regulation) Act, 2014, as not maintainable.

Learned counsel for the petitioner has drawn my attention to the order dated 12th September, 2024 SKNair

937-wp-4019-24(j).odt passed by this Court in Review Application 196 of 2024. By the said order, this Court has recalled the decision dated 24th April, 2024 passed in Writ Petition No. 14389 of 2019.

In that view of the matter, the following order is passed.

i.

The order impugned is set aside.

ii.

Respondent no.1 shall decide the Revision Application No. 43 of 2022 filed by the present petitioner on it's own merits.

iii.

The parties shall appear before the respondent no.1 on 9th January, 2025.

iv.

Needless to mention that the interim order which was passed by the respondent no.1 shall remain in operation till the decision of the revision.

v.

Respondent no.1 shall endeavour to decide the revision within a period of four months from the date of appearance of the parties.

The writ petition is disposed of in aforesaid terms.
