One of the challenges is, name of the petitioner No.2 educational institute has not been included in CAP round and hence, no students are allotted to it till date. 2.
The learned G.P. upon instructions has produced an E-mail. It is taken on record and marked as "X" for identification. As per that document, name of the petitioner No.2 has been added as one of the available institute to which students who have passed 10th standard can take admission through CAP.

It is not in dispute that the first round is already over and the learned G.P. states that hence the students still participating in CAP can participate in second round and aspire for admission in petitioner No.2 institution. 4.
According to Advocate Shri Kulkarni, admissions as per the first round are still not over.

We find that CAP rounds are still going on and if there are any students who have still not taken admissions and therefore, are entitled to opt for or shift to petitioner No.2 institution, it is open for them to do so as per the Rules. 6.
For the present, the grievance made by the petitioners does not survive. Hence, leaving all other contentions and grounds open and with liberty to the petitioners to approach again with the same, we dispose of the present petitioner. No costs.
