Khanzode, learned counsel for the appellant on instructions submits that with passage of time the appellant has superannuated from service and hence the challenge raised in the present appeal does not require adjudication. Accepting the aforesaid statement the Letters Patent Appeal is disposed of as having been rendered infructuous. The respondent No.3 who had approached before the School Tribunal in Appeal No.STC/35/2008 is free to adopt such steps as are permissible in law pursuant to that adjudication. The parties shall bear their own costs.
