Mr.Nemade, learned counsel for the applicant submits that in view of judgment delivered by this Court on 13.07.2017 in First Appeal No.570/2005, the present appeal can be disposed of in terms of the said judgment. However, this position is disputed by the learned counsel for non applicant no.3.

Be that as it may. The other prayer for grant of early hearing of the present first appeal, which is of the year 2008 and as this Court is taking up the appeals

caf1865.18.odt of the years 2006 and 2008, can be granted. In that view of the matter, present application is allowed in terms of the alternate prayer.

Registry is directed to fix the appeal for final hearing as per its turn.
