Heard learned counsel for respondent no.1 and learned counsel for appellant.

This is an application seeking withdrawal of the amount of compensation deposited in the court. Learned counsel for appellant submits that he has no objection for withdrawal of 50% of the amount deposited in the court, subject to usual undertaking. In view thereof, respondent no.1 is permitted to withdraw 50% of the amount of compensation deposited in the court, subject to furnishing of usual undertaking.

As regards the second prayer made in this application by respondent no.1 for direction to appellant to deposit remaining amount of compensation of

2607 CAO 815-2017 2/2 Rs.2,45,200/- along with interest, learned counsel for appellant points out that this amount was added subsequently in the order of the Tribunal after its modification of the award and appellant may take necessary steps to challenge the same.
