Provisions of Rule 4.6 of NEET-UG-2018 admission procedure mandate passing of HSC/12th Examination from the State of Maharashtra. The petitioner has passed 12th standard from Shri Chaitanya Vidya Niketan, Vishakhapattanam. Hence, erroneous inclusion of name in the provisional State Merit List does not clothe the petitioner with any right.

The orders at Bombay passed on 19th June, 2018 consider Rule 4.5 and earlier insistence upon having passed SSC/10th examination from the State of Maharashtra. The stipulation on these lines in admission brochure was found inconsistent with Rules and hence, this Court at Nagpur and thereafter at Bombay has directed the respondents to remove the inconsistency. Accordingly, the notice looked into in paragraph 2 at Bombay was issued. It is restricted only to and for benefit of the students who have passed SSC from other States.
