The present appeal is preferred challenging the order dated 12/02/2024, passed by the learned District Judge - 2, Kelapur on application at Exh.80 in Regular Civil Appeal No.33/2015, whereby application for grant of temporary injunction against creation of third party rights over the suit property is rejected by the learned first Appellate Court.

Mr. Chaudhari, learned Advocate for the appellants states that appeal was initially filed before this Court and was registered as First Appeal No.69/2001 and thereafter in view of increase in pecuniary jurisdiction of the District Courts, appeal is remitted to the District Court and is registered as Regular Civil Appeal No.33/2015. He prays that since appeal is pending over 25 years, learned first Appellate Court be directed to decide the appeal expeditiously.

Request is reasonable. Learned first Appellate Court is requested to decide the appeal as expeditiously as possible and in any case before 30/04/2026. This is subject to condition that the appellants shall take urgent steps for bringing legal representatives of deceased parties on record. 4.

Appeal Against Order is disposed of accordingly. No order as to costs.
