Apprehending arrest in connection with Crime No.297/2017 registered by the non-applicant for the offence punishable under Section 306 of the Indian Penal Code and Section 67 of the Information Technology Act, the applicant has sought pre-arrest bail.
The accusations against the applicant are that he had been sending objectionable messages to deceased because of which she has committed suicide.
The applicant, aged about 20 years, claims to be a student of engineering course and has stated that he is not involved in any other crime / offence. The learned Advocate for the applicant has pointed out that this Court has granted interim
2 aba471.17 protection to the applicant by order passed on 3rd July, 2017 imposing condition of attendance at the police station, the applicant has complied with the order, co-operated with the investigating agency and has surrendered his cellphone. The learned A.P.P. has not controverted the above submission.
Considering the facts of the case and nature of accusations against the applicant, the order passed by this Court on 3rd July, 2017 granting interim protection to the applicant is confirmed. The application is allowed accordingly.
