It is seen that huge quantity of country liquor have been seized from the co-accused Rupchand Meshram and during the course of investigation, the role played by this applicant in commission of the crime of Rupchand Meshram suppressed. He has been stated to be a supplier of liquor to Rupchand and others. The police would therefore require to go about the investigation of carrying out the custodial interrogation of this applicant. In the year year 2016 between the period from February, 2016 to April, 2016, at least four offences punishable under Section 65(e) and 83 of the Bombay Prohibition Act came to be registered against this applicant. Similar two offences were also registered against him in the year 2015. All these circumstances create reasonable suspicion against the applicant and as the applicant appears to be habitual offender, he would not be entitled to be granted relief of anticipatory bail. The application is rejected.
