Heard Shri D.A. Sonwane, learned counsel (appointed) for the applicant/ appellant and Shri M.J. Khan, learned APP for the respondent.
The only submission is, the appellant - accused is insane and as such, no offence can be presumed to be committed by him.
The learned APP submits that the burden is upon the appellant to prove it under Section 84 of the Indian Penal Code and that burden has not been discharged by him and the material on record does not indicate that the applicant/ appellant is insane.
We have heard the respective counsel. Taking over all view of the matter, we feel it appropriate to expedite the hearing of the Appeal.
List the Criminal Appeal for fixing the date of hearing after the paper book is prepared.
