DATE : JUNE 21, 2016 In these contempt petitions, it is the grievance of each petitioner that the directions issued by this Court in W.P.No.4510 of 2013 with connected writ petitions dated 04/10/2013 have not been complied with. As per the direction issued in these writ petitions the Zilla Parishad, Wardha was directed to submit a proposal to the Divisional Commissioner, Nagpur through the Collector, Wardha in the matter of regularisation of the services of these petitioners for being processed in terms of the Government Resolution holding the field. Till said exercise was completed, the petitioners were directed to be continued in service. In view of the grievance regarding noncompliance of these directions, this Court had issued notice before admission to the respondents.

Shri P. D. Meghe, the learned counsel for the respondent No.1

4/4 and Shri K. L. Dharmadhikari, the learned Assistant Government Pleader for the respondent Nos.2 to 4 state that during pendency of the present proceedings fresh process of selection was undertaken in which the petitioners had participated. Reference is made to the communication dated 16/06/2016 issued by the respondent No.2 to the respondent No.1. Copy of the said communication is taken on record of Contempt Petition No.145/2014 and marked as 'A' for identification. As per this communication, the services of each petitioner could not be regularised.

Considering the fact that the process of regularisation was undertaken in which the petitioners had participated, there is no further reason to keep the present proceedings pending. The order passed in Writ Petition No.4510/2013 dated 04/10/2013 stands complied with. In view of aforesaid the contempt petitions are disposed of. Needless to state that if the petitioners are aggrieved by their non-selection, they are free to take appropriate steps to challenge the same if so advised.
