DATE : 18.07.2016 By this writ petition, the petitioner - Adiwasi Halba/Halbi Samaj Sanghtana has challenged the inaction on the part of the respondent no.3 - Collector, Ahmednagar in taking appropriate action for reversion of Shri Chandrabhan Parate, whose caste claim is invalidated by the Scrutiny Committee on 1.2.2016.

It is stated on behalf of the petitioner that though this Court had by the judgment, dated 19.9.2013 in Writ Petition No.6029/2012 directed that the promotional benefits granted to Shri Chandrabhan Parate should be withdrawn, if his caste claim is invalidated, the respondent no.3 - Collector, Ahmednagar has not taken appropriate action in terms of the judgment, dated 19.9.2013 despite the representation made by the petitioner.

The writ petition would not lie before the Nagpur Bench of the Bombay High Court. By filing this writ petition, the petitioner has sought a direction against the Collector, Ahmednagar to take appropriate action of reversion against Shri Chandrabhan Parate. If the petitioner is seeking a direction against the Collector, Ahmednagar, the petitioner would be required to file appropriate proceedings at the Aurangabad Bench.

In the circumstances stated herein above, we decline to entertain the writ petition. The writ petition is disposed of with no order as to costs. The points raised in the petition are kept open.
