The petitioner seeks liberty to withdraw the petition if it is clarified that the decision of the authority, rendered under Section 143 of the Maharashtra Land Revenue Code, 1966 shall be subject to the decision in the appeal which is preferred by one of the field owners, who is similarly situated as the petitioner herein.

Respondent 3, on whose application, the order impugned is passed, has no objection to such an arrangement. 3.
The petitioner is permitted to withdraw the petition and with consent it is directed that the order impugned shall be subject to the decision of the Civil Court in appeal.

The writ petition is disposed of accordingly. No costs.
