Heard the learned Counsel appearing for the applicant. The non-applicant has been served twice, however, he is absent. No reply to this application has been filed. Nobody represents the non-applicant.

It is obvious that the non-applicant does not wish to contest this application. Even otherwise, considering the facts of this case, particularly the fact that the applicant has a three years old daughter to be looked after, I am of the view that the interest of justice in this case shall be served by allowing this application.

The application is allowed. H.M.P. No.33/2016 pending on the file of Civil Judge Senior Division, Darwha stands transferred to the file of the Civil Judge Senior Division, Wardha for disposal in accordance with law. No costs.
