DATE : 18.07.2016 By this writ petition, the petitioner challenges the entire examination conducted by the deemed University formed under the Mahatma Gandhi Antarrashtriya Hindi Vishwavidyalaya Act for the course of M.Phil. in Migration and Diaspora studies for the academic year 2016-17.

It is the case of the petitioner that the respondent - Vidyalaya illegally posed similar questions to the students, that were appearing at the M.Phil. examination and the Ph.D. examination in the subject of Migration and Diaspora studies. It is stated that some of the questions posed for the M.Phil. students like the petitioner did not relate to bookish knowledge and related to research work. It is stated that in view of the wrongful setting of question paper, the petitioner has failed in the said examination.

On hearing the learned Counsel for the petitioner and on a perusal of the documents annexed to the writ petition, we do not find that there is any scope for cancellation of the examination conducted by the respondent and the question paper for the M.Phil. Migration and Diaspora studies. We have perused the question paper in detail. None of the questions relate to the research work. All the questions in the question paper are objective and relate to bookish knowledge. Merely because the petitioner has failed in the examination, the petitioner cannot effectively challenge the setting up of a question paper by the respondent, specially when some other students have cleared the examination in the said subject.

Since we do not find any merit in the writ petition, the same is dismissed with no order as to costs. JUDGE JUDGE Wadkar
