The order passed by the Industrial Court rejecting the application filed by the petitioner under Section 30(2) of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 is challenged. By the impugned order, the Industrial Court has refused to grant stay to the order transferring the petitioner from Nagpur to Ramtek which is at a distance of about 45 to 50 kms. The Industrial Court has recorded that the employer has granted permission to the petitioner-employee to leave the headquarters and has not directed that he will continue to stay at headquarters.

I do not find any illegality or perversity in the impugned order. The petition is dismissed. No costs.

2 wp4128.16 Looking to the nature of dispute, the Industrial Court is directed to dispose the complaint filed by the petitioner till 30-03-2017.
