The petitioner - Bank and respondent no.1Vishwanath Chandrikaprasad Gupta, have filed a joint pursis in this Court signed by them as well as by their Counsels stating that the matter has been settled between them on the terms as contained therein.

In the first half, the matter was referred to the Registrar (Judicial), requesting him to verify the settlement and identity of the parties and submit a report, in accordance
2702wp6207.12 with wp713.2020.odt with which the Registrar (Judicial) has submitted a report, which states that he has verified the identities of the parties and the petitioner - Bank as well as respondent no.1 have confirmed the contents of the one time settlement proposal, mentioned in the pursis and the terms and conditions as contained therein.

In light of the report, the settlement as reflected in the pursis dated 27/2/2020 is accepted. The petitioner - Bank is therefore permitted to withdraw the amount of Rs.6,10,263/- deposited in this Court in pursuance of the order dated 30/10/2017 in Writ Petition No.6207/2012 and so also the further amount of Rs.5,00,000/-, as deposited in this Court in Writ Petition No.713/2020, in pursuance of the order dated 11/2/2020.

Since the settlement is recorded, there shall be an award in terms thereof, as the matter arises out of proceedings under Section 91 of the Maharashtra Co-operative Societies Act, 1960.
Both the writ petitions are accordingly disposed of in terms of the settlement. No order as to costs. JUDGE Wadkar, P.S.
