It is the contention of the learned counsel for the applicant that the applicant is out of service since the year 2006 and meanwhile has attained the age of superannuation. He further submits that the applicant is facing financial crisis and has a good case on merit as this is a case wherein, according to the applicant, no valid sanction has been given for prosecution of the applicant.

Learned A.P.P. for the State submits that appropriate order may be passed.

Having considered the submissions and also the fact that the applicant has now became senior citizen, I am of the view that this application deserves to be allowed. The application is allowed and it is directed that the appeal be listed for final hearing in the week commencing from 19th September, 2016.
