MARCH 24, 2017 Crime No. 127/2009 for an offence punishable under Sections 498-A, 292, 406 and 34 of the Indian Penal Code came to be registered against the respondent no.2.
The applicant claimed that though on June 20, 2016, when she appeared before the Court in the aforesaid matter, the respondent no.2-accused threatened her and asked her not to attend the Court.
N.C.came to be registered pursuant to Section 115 of the Code of Criminal Procedure based on which the proceedings of the matter bearing R.C.C.No. 1123/2009 is sought to be transferred from the Court of J.M.F.C. Court No.4, Amravati, to the Court at Nagpur. After having heard learned counsel for the applicant and learned Additional Public Prosecutor for respondent State, this Court intents to pass the following order :

ORDER
(i) N.C. registered with the Police Station, Gadgenagar, Amravati, is brought to the notice of the learned Magistrate, who is taking up the aforesaid trial. (ii) The learned Magistrate shall look into it and if satisfied, may order providing protection to the applicant or may order for such other measures as will be necessary so as to ensure presence of the witness before the Court in the said trial.
Since the order passed is not prejudicial to the interest of respondents 2 to 5, service to all of them is dispensed with. With the aforesaid observations, the Criminal Application stands disposed of.
