Shri P.N. Kothari, learned Counsel for the applicants, Mrs. K.S. Joshi, learned A.P.P. for respondent no.1 and Respondent no.2 -In-person. 2.
This Court on 18.12.2015 while issuing notice in the matter permitted investigation to go on and directed that charge sheet should not be filed. It appears that inadvertently charge sheet came to be filed on 24.02.2016. Because of this inadvertent error, government has also moved an application before the trial Court seeking leave to withdraw the charge sheet so presented.

We do not wish to go into the merits of the
controversy. Misc. Criminal Application has been filed to raise appropriate challenges to charge sheet as presented. Though respondent no.2 in-person and learned A.P.P. are opposing the amendment, without considering the merits of said amendment, we grant leave to the applicants. Necessary amendment be carried out within a period of one week. Liberty to respondents to file their additional reply if any, within further two weeks.
