The petitioner is aggrieved by the order dated 12-5-2023 passed by the Sub-Divisional Officer refusing to issue a caste certificate to the petitioner. Under Section 5 of the Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes, Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000, remedy of filing an appeal against such order is provided. 2.
Hence with liberty to the petitioner to avail the statutory remedy and by keeping all points raised in the writ petition open, the writ petition is disposed of. If the petitioner files such appeal within a period of two weeks from today, the same shall be decided on merits within a period of four weeks of receiving such appeal and it shall not be dismissed on the ground of delay.
