Heard Ms. S.B. Khobragade, learned counsel (appointed) for the petitioner and Ms. M.H. Deshmukh, learned A.P.P. for respondents. Perused reply.

Application seeking parole on the ground of illness of father by petitioner is rejected on the ground that illness is not serious, and there are two other sons to take his care.

During arguments we find that the application was moved some time in October, 2015. Thus, period of more than one year has expired. In

view of this, without commenting anything on the merits of the controversy, we grant leave to petitioner, that if he is entitled, he can move a fresh application, in accordance with law along with necessary documents. If such application is moved within a period of four weeks, the same shall be decided by the competent Authority within a period of two weeks, thereafter.

With above liberty and directions, we dispose of the present Writ Petition. No costs. 5.

Fees for the learned counsel appointed for the petitioner is quantified at Rs. 1500/-.
