05th August, 2016 Shri Shamkuwar, the learned counsel for the applicant, submits that the decisions relied upon while dismissing the Writ Petition consider the position under the provisions of Section 125, Criminal Procedure Code. He submits that the present proceedings arise out of an order passed under Section 18 of the Hindu Adoption & Maintenance Act, 1956.

Having heard the learned counsel, I do not find that the legal position would change if an order directing payment of maintenance by the Civil Court is not complied with. This aspect is clear from the observations in paragraph 10 of the judgment in Naseera Begum & others Vs. Syed Habibur

Rehman & another [1995 (1) Mh. L.J. 321]. Hence there is no ground made out to review the judgment. Application is rejected.
