DATE :
31st August, 2015.
01.
Heard Shri M.V. Samarth, learned counsel for the Applicant and Shri V.A. Thakre, APP for respondent. 02.
By the present appliction, the applicant is seeking his release on anticipatory bail since he is apprehending arrest in connection with Crime No. 165/15 registered with Police Station, Bhandara, for the offences punishable under Sections 120-B, 406, 407, 408, 409 and 468 of Indian Penal Code.
03.
The First Information Report is lodged by Mr. Tushar Navneet Wagh, who is the Deputy Regional
Manager of Adiwasi Vikas Mahamandal, Deori, Distt. Gondia. From the First Information Report and the Reply, it is clear that the present applicant has failed in his duty and he has not taken any steps for stopping the transportation of the paddy, which, according to the prosecution, is against the rules.
04.
This Court has already rejected the anticipatory bail application of one Shri Roshan Karemore who was found to be actually transporting the commodity. 05.
The allegation made against the present applicant reveals that at the most, it will be an administrative lapse on the part of the present applicant, for which his custodial presence is not required. That leads me to pass the following order:-
