Heard Shri S.S. Ghate, learned counsel for the petitioner/ applicant, Ms. A.R. Kulkarni, learned AGP for respondent No. 1 and Shri Ankush Kalmegh, learned counsel for respondent No. 2 2.

In view of subsequent change in policy, the grievance made in the petition does not survive. 3.

Shri Ghate, learned counsel, learned counsel, however, submits that the petitioner is going without Secretary, since last more than seven years and now panel supposed to take decision is still not in place. He, therefore, seeks leave to appoint the Secretary, in the meanwhile. 4.

Shri Kalmegh, learned counsel points out that the decision is left to panel and the panel is still not formed. 5.

In this situation, we find that the request made by Shri Ghate, learned counsel, travels beyond the scope of present petition. Hence, without prejudice to it, we dispose of the present Civil Application as also Writ Petition. No order as to costs.
