This is an application for condonation of delay. There is delay of 1473 days in filing the second appeal. 3.

The learned counsel for the applicant states that there are mainly two grounds on which the applicant is seeking condonation of delay. First ground is as regards ailment of the applicant and his granddaughter and the second is, though the papers were handed over to the lawyer for preparing second appeal, the applicant did not receive knowledge of sad demise of his lawyer and after receiving the said knowledge steps were taken and in that process delay has been caused.

Smt. Deshpande, learned counsel appearing for the non-applicant submits that she has no serious objection in allowing the application. In absence of any

2 cas368.21 serious objection and as I have found reasons stated in the application are satisfactory to condone the delay, the application is allowed.
