JULY 12, 2017 By the present revision, the applicant is seeking to challenge the order passed by the learned Assistant Sessions Judge, Akola dated 24.04.2017 in Sessions Trial No. 116/2013 by which the learned Assistant Sessions Judge rejected the application for discharge.

Heard Mr. Dhore, learned counsel for the applicant. He submits that there is no material against the present applicant and therefore the order rejecting the application for discharge is erroneous.

The present applicant is prosecuted for an offence punishable under Sections 143, 147, 148, 149, 323, 324 of the Indian Penal Code and Sections 3 (i) (x) of the Scheduled Caste and Scheduled Tribes Prevention of Atrocities Act vide Crime No. 105/2013 registered with Police Station, Barshi Takli. Though it was expected from the applicant to file entire copy of the charge-sheet, for the reasons best known to the applicant, it is not filed and only copy of the FIR is placed on record. With the assistance of

revn84.17.odt the learned counsel, I have gone through the FIR which specifically points out the presence of the present applicant and also the words uttered by him coupled with assault. Thus, in my view, there is sufficient material against the present applicant. No mistake at law is committed by the Court while rejecting the application.
